COVID-19 causes Courts to delay Deadlines

Last week, a new Ohio law (HB 197) was enacted, providing specific Coronavirus/COVID-19 relief.  Included in that law are specific provisions which affect lawsuits and litigation:

  • Statutes of limitation and litigation deadlines in both civil and criminal matters that appear between March 9, 2020 and July 30, 2020 are being tolled or otherwise delayed without limitation or exclusion.   

  • All discovery deadlines, set between March 9, 2020 and July 30, 2020, are tolled as well.

  • Service of pleading deadlines that expire between March 9, 2020 and July 30, 2020 are tolled.

  • There is also a catch-all provision which states that “any other criminal, civil, or administrative time limitation or deadline under the Revised Code” is tolled if it set to occur between March 9, 2020 and July 30, 2020.

These tolling provisions are set to expire on “the date the period of emergency ends or July 30, 2020, whichever is sooner.
